Terms of Service

Welcome to Capture & Cook ("we," "us," "the Service"), available at captureandcook.com and operated by Capture & Cook LLC, a Michigan limited liability company. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service Does
Capture & Cook uses artificial intelligence to analyze photos of food, generate recipes, estimate nutrition and grocery costs, identify restaurant meals, suggest homemade alternatives, and suggest ingredient substitutions for common allergens and dietary preferences. It also includes community features where users can share food photos, react, and comment.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the consent of a parent or guardian. By using the Service you represent that you meet these requirements.
3. Your Account
You are responsible for your account and for keeping your password secure. You must provide accurate information. We may suspend or terminate accounts that violate these Terms. You may delete your account at any time by contacting support@captureandcook.com.
4. Important: AI-Generated Content, Allergy & Health Disclaimer
The Service's recipes, calorie counts, nutrition facts, ingredient lists, equipment lists, cost estimates, restaurant-meal identifications, and allergy/dietary substitution suggestions are generated by artificial intelligence and are estimates only. They may be inaccurate or incomplete.
⚠️ Allergy & dietary warning. Our allergen detection works by scanning ingredient names and may miss allergens, hidden ingredients, trace amounts, or cross-contamination. Substitution suggestions are general ideas, not guarantees of safety.
If you have a food allergy, intolerance, or medical condition, always verify every ingredient yourself and consult a qualified medical or dietary professional. Never rely on the Service alone to determine whether a food is safe for you to eat.
- The Service is not a medical, dietary, or nutrition advice service.
- Restaurant nutrition figures are estimates based on publicly available information and may differ from the restaurant's current official values.
- Cost estimates are approximations and vary by location and time.
You use all AI-generated content at your own risk.
5. User Content (Community Features)
When you post photos, captions, comments, or other content ("User Content"):
- You own your content. You grant us a non-exclusive, worldwide, royalty-free license to host, display, and distribute it within the Service so the features work (e.g., showing your post in the feed).
- Food photos only. The community feed is for photos of food and drink. We use automated screening and may remove content that is not food-related.
- You are responsible for what you post. Do not post content that is illegal, infringing, hateful, harassing, sexually explicit, violent, deceptive, or that violates anyone's privacy or rights.
- We may remove any User Content or restrict any account at our discretion, including in response to user reports.
- Other users can see your username and the content you share publicly.
6. Acceptable Use
You agree not to: use the Service for any unlawful purpose; harass, abuse, or harm other users; upload non-food imagery to the community feed or attempt to bypass content screening; attempt to access other users' data or probe, scan, or test the Service's security; scrape, copy, or resell the Service or its content; reverse engineer the Service; or impersonate any person or misrepresent your affiliation.
7. Intellectual Property
The Service — including its name, logo, design, and software — is owned by Capture & Cook LLC and protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or branding.
8. Third-Party Services
The Service relies on third-party providers (including AI processing, database/hosting, mapping, and email services). Their availability affects the Service, and your data is processed by them as described in our Privacy Policy.
9. Termination
We may suspend or terminate your access at any time for violation of these Terms or to protect the Service or its users. Sections 4, 5, 7, 10, 11, and 12 survive termination.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPTURE & COOK LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE — INCLUDING RELIANCE ON AI-GENERATED RECIPES, NUTRITION INFORMATION, OR ALLERGY SUBSTITUTIONS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF $50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Capture & Cook LLC from claims arising out of your User Content or your violation of these Terms.
13. Governing Law
These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Michigan.
14. Changes to These Terms
We may update these Terms. We will post the updated version with a new effective date; material changes may be announced in the app. Continued use after changes means you accept them.

Privacy Policy

This Privacy Policy explains what information Capture & Cook LLC ("we," "us") collects, how we use it, and your choices. It applies to captureandcook.com.
1. Information We Collect
Account information. When you sign up: your email address, name, and password (stored in hashed form by our authentication provider). If you sign in with Google, we receive your name and email from Google.
Profile information. Your chosen username, avatar color/icon, any allergy or dietary preferences you select, and (if you save one) your address or zip code for finding nearby stores.
About allergy & dietary preferences. If you choose to save allergies or dietary preferences, this may be considered sensitive health-related information. Providing it is entirely optional. We use it only to flag ingredients and suggest substitutions for you inside the app. We do not sell it, and it is not shown to other users.
Photos you upload. Food photos you submit for dish analysis, takeout scanning, or community sharing. Photos are compressed on your device before upload.
Content you create. Recipes saved to your history, favorites, ratings, community posts, captions, comments, reactions, and reports you submit.
Support messages. If you contact support, we receive your name, email, and message.
Technical information. Like most web services, our hosting providers automatically log basic technical data (such as IP address and browser type) for security and operations.
We do not collect payment information (the Service is currently free) and we do not use advertising trackers.
2. How We Use Your Information
- To provide the Service: analyze your food photos with AI, generate recipes and nutrition estimates, flag allergens and suggest substitutions based on your saved preferences, save your history and favorites, show your posts in the community feed, and find stores near your saved address.
- To screen community uploads so only food photos are shared.
- To respond to support requests and reports.
- To secure the Service and prevent abuse.
- To send essential account emails (e.g., email verification, password reset, support replies). We do not send marketing email without your consent.
3. AI Processing
Photos you submit for analysis, takeout scanning, or community-feed screening are processed by our AI provider (Anthropic) to generate results. When you run an allergy check, the dish name, its ingredient list, and the allergens being checked are sent to the AI provider to generate substitution suggestions. Saved addresses and store searches are processed by Google's mapping services to return nearby results. We send only what is needed for the feature to work.
4. Who Can See Your Information
- Community content is visible to other signed-in users: your username, avatar, posts, captions, comments, and reactions.
- Private by default: your email, name, saved address, allergy/dietary preferences, dish history, favorites, and support messages are not visible to other users.
- Database rules (row-level security) enforce that users cannot access each other's private data.
5. Service Providers
We use trusted third parties to operate the Service:

These providers process data on our behalf under their own security and privacy commitments. We do not sell your personal information.
6. Data Retention & Deletion
We keep your data while your account is active. You can delete individual posts, comments, and history items in the app, or request full account deletion by emailing support@captureandcook.com — we will delete your account data within 30 days, except where retention is required for legal or security reasons.
7. Security
We use industry-standard measures including encrypted connections (HTTPS), hashed passwords, and database row-level security. No system is perfectly secure; please use a strong, unique password.
8. Children
The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child under 13 has created an account, contact us and we will delete it.
9. Your Rights
Depending on where you live, you may have rights to access, correct, or delete your personal information. To exercise these rights, email support@captureandcook.com. We will respond within a reasonable time.
10. Cookies & Local Storage
We use minimal browser storage to keep you signed in and to remember device-level preferences (such as a saved address fallback). We do not use third-party advertising cookies.
11. Changes to This Policy
We may update this Policy and will post the new version here with an updated effective date. Material changes may be announced in the app.
